2. Description of Service

AmpliRank provides AI-powered brand visibility analytics and competitive intelligence through our AI Visibility platform. The Service allows users to:

• Track brand mentions across AI platforms (ChatGPT, Gemini, Perplexity, etc.)
• Monitor competitor visibility and rankings
• Generate visibility reports and sentiment analysis
• Access historical trend data and analytics

Service features and availability may vary based on your subscription tier. We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable notice.

3. User Accounts & Registration

To use the Service, you must:

• Create an account with accurate and complete information
• Be at least 18 years old or have parental/guardian consent
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access

You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscription Plans & Billing

4.1 Free Trial

New users receive a 7-day free trial with limited features (2 brands, 5 analyses, Gemini platform only). No credit card is required for the trial. Trial accounts automatically expire after 7 days unless upgraded to a paid plan.

4.2 Paid Subscriptions

Paid plans are billed monthly in advance:

• Starter: $99/month - 3 brands, 15 analyses, Gemini + ChatGPT
• Pro: $299/month - 5 brands, 18 analyses, all 4 AI platforms (Gemini, ChatGPT, Claude, Perplexity), PDF export
• Enterprise: $799/month - 10 brands, 40 analyses, all 4 platforms, custom solutions

4.3 Payment Terms

Payment is processed through Stripe. By providing payment information, you authorize AmpliRank to charge your payment method on a recurring monthly basis. Subscription fees are non-refundable except as required by law.

4.4 Cancellation & Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the billing period. No partial refunds are provided for unused time in a billing period.

5. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction (including copyright laws)
• Reverse engineer, decompile, or disassemble the Service
• Use automated systems (bots, scrapers) to access the Service
• Attempt to gain unauthorized access to our systems or other user accounts
• Transmit malicious code, viruses, or harmful software
• Resell, redistribute, or sublicense the Service without written permission
• Use the Service to harass, abuse, or harm others

Violation of this policy may result in immediate account termination without refund.

6. Intellectual Property Rights

The Service, including all content, features, functionality, software, code, and design, is owned by AmpliRank and protected by international copyright, trademark, and other intellectual property laws.

Your Data: You retain all rights to the brand names, queries, and data you input into the Service. AmpliRank may use this data in aggregated, anonymized form for analytics and service improvements.

License Grant: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes in accordance with these Terms.

7. Data Accuracy & Third-Party Services

AmpliRank aggregates data from third-party AI platforms (Google Gemini, OpenAI ChatGPT, Anthropic Claude, etc.). We strive for accuracy but cannot guarantee that all data is 100% accurate or up-to-date.

No Warranty: The Service is provided "as is" without warranties of any kind. We do not guarantee specific results, rankings, or visibility improvements from using the Service.

8. Limitation of Liability

To the maximum extent permitted by law, AmpliRank shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or business information
• Service interruptions or downtime
• Decisions made based on data from the Service

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to AmpliRank in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless AmpliRank, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content or data you submit to the Service

10. Termination

Either party may terminate this agreement at any time:

• By You: Cancel your subscription from account settings
• By Us: We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or for non-payment

Upon termination, your right to access the Service ceases immediately. We may delete your account data after 90 days, as outlined in our Privacy Policy.

11. Dispute Resolution & Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

Informal Resolution: Before filing a claim, you agree to contact us at syntarix@gmail.com to attempt to resolve the dispute informally.

Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of [Arbitration Body]. You waive your right to a jury trial or to participate in a class action lawsuit.

12. Changes to Service

AmpliRank reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We will make reasonable efforts to notify users of material changes via email or in-app notifications.
